Terms and Conditions of Sale

These Terms and Conditions of Sale apply to purchases made from RareLock.

They should be read together with our Return and Refund Policy, Shipping Policy, Privacy Policy and Terms of Service.

2. Products

RareLock sells trading card protection, display and collection accessories, including magnetic card holders and related products.

We make reasonable efforts to ensure that product photographs, descriptions, dimensions, specifications and compatibility information are accurate.

Before ordering, customers should review the dimensions, card thickness compatibility and other specifications displayed on the product page.

This requirement does not limit any consumer right where a product is faulty, materially different from its description, not fit for a disclosed purpose or otherwise fails to meet a mandatory consumer guarantee.

Minor differences in colour or appearance may occur due to lighting, photography, screen settings or manufacturing variations, provided that the product remains materially consistent with its description.

3. Orders

By placing an order, you confirm that:
- the information you provide is complete and accurate;
- you are authorised to use the selected payment method; and
- you have reviewed the relevant product information before purchase.

Submitting an order does not guarantee acceptance.

We may refuse or cancel an order where reasonably necessary, including because of:
- product unavailability;
- an obvious pricing or listing error;
- suspected fraud or unauthorised payment;
- an invalid or undeliverable delivery address; or
- circumstances that make fulfilment impossible.

If we cancel an order after payment has been received and the goods are not supplied, the amount paid for the cancelled order will be refunded.

4. Prices, Taxes and Duties

Prices are displayed in the currency shown on the website or at checkout.

The total amount payable will be displayed before the customer completes the purchase, including any charges collected by RareLock at checkout.

Depending on the delivery destination, customs duties, import taxes or other government charges may apply.

Where such charges are not collected at checkout, they may be payable by the recipient, subject to applicable law.

Nothing in this section permits RareLock to charge an amount that was not properly disclosed where disclosure is required by law.

5. Payment

Orders must be paid using one of the payment methods made available at checkout.

Payment must be successfully authorised before an order can be processed.

Payment transactions may be processed by Shopify or other third-party payment providers.

RareLock does not directly store full payment card details submitted through the Shopify checkout.

6. Order Processing and Shipping

Orders are shipped to the delivery address provided during checkout.

Customers are responsible for checking that their delivery information is accurate before completing an order.

If you notice an error after ordering, please contact us as soon as possible. We will try to assist, but changes may no longer be possible once fulfilment or shipping has begun.

Processing and delivery timeframes are estimates unless expressly stated otherwise.

Delivery may be affected by carrier operations, customs processing, public holidays, weather events, fulfilment delays or other circumstances outside our reasonable control.

7. Tracking

Where tracking is available, tracking details will be provided after dispatch or made available through our Track Your Order service.

Tracking information may take approximately 24–48 hours after dispatch to begin displaying updates.

Carrier tracking information is provided by third-party logistics services and may occasionally be delayed or temporarily inaccurate.

8. Returns and Change-of-Mind Requests

Returns and refunds are governed by our Return and Refund Policy.

For voluntary change-of-mind returns, customers must comply with the eligibility conditions and timeframes stated in that policy.

These voluntary conditions do not limit any mandatory rights relating to faulty, damaged, incorrect or misdescribed products.

Where a mandatory right of withdrawal, cancellation or return applies under the law applicable to a customer, that mandatory right takes priority over any inconsistent voluntary store condition.

9. Faulty, Damaged or Incorrect Products

If a product arrives damaged, is defective, is materially different from its description or the wrong product has been supplied, please contact RareLock as soon as reasonably possible.

We may request reasonable evidence, such as photographs or video, to help assess the issue.

Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, refund or compensation.

Nothing in these Terms restricts remedies that cannot legally be excluded.

10. Australian Consumer Law

Where the Australian Consumer Law applies, goods purchased from RareLock come with consumer guarantees that cannot be excluded by these Terms.

Depending on the nature and seriousness of a failure, customers may be entitled to a repair, replacement, refund and, in some circumstances, compensation for reasonably foreseeable loss or damage.

RareLock's voluntary return conditions operate in addition to these statutory rights.

11. Refunds

Where a refund is required or approved, it will normally be issued to the original payment method unless the customer agrees to another method.

After RareLock processes a refund, additional processing time may be required by the customer's bank, card issuer or payment provider.

Where applicable law gives the customer the right to choose between available remedies, RareLock will respect that right.

12. Risk, Delivery and Lost Parcels

A shipment will not automatically be treated as successfully delivered solely because a carrier tracking page records a delivery event where the circumstances reasonably indicate that the customer did not receive the goods.

If an order appears lost, misdelivered or materially delayed, customers should contact RareLock so that the shipment can be investigated with the relevant carrier.

Any rights concerning non-delivery or loss remain subject to applicable consumer law.

13. Product Use

Customers should use products in accordance with their intended purpose and any instructions or compatibility information provided.

RareLock is not responsible for damage caused solely by misuse, unauthorised modification or use clearly inconsistent with the product's intended purpose, to the extent permitted by law.

This does not apply where loss or damage results from a product failing to meet a mandatory consumer guarantee.

14. Intellectual Property

The RareLock name, branding, website design, original text, graphics and other original content are protected by applicable intellectual property laws unless otherwise stated.

Purchasing a product does not grant the customer any ownership or licence over RareLock intellectual property other than the right to use the purchased product normally.

15. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot legally be excluded or limited.

To the extent permitted by law, RareLock is not responsible for loss caused solely by events outside our reasonable control or by a customer's misuse of a product.

This clause does not exclude liability for reasonably foreseeable loss or damage where compensation is required under applicable consumer law.

16. Force Majeure

RareLock will not be responsible for a delay or failure to perform an obligation where performance is prevented by circumstances outside our reasonable control, such as severe weather, natural disasters, carrier disruptions, customs disruptions, governmental actions, widespread network failures or similar events.

We will make reasonable efforts to minimise the effect of such circumstances.

Nothing in this section removes rights that cannot legally be excluded.

17. Governing Law

These Terms and Conditions of Sale are governed by French law.

However, this choice of law does not remove or reduce any mandatory consumer protections that apply to a customer under the laws of their country or jurisdiction.

In particular, where the Australian Consumer Law applies, its mandatory consumer protections continue to apply.

18. Changes to These Terms

We may update these Terms and Conditions of Sale from time to time.

The terms applicable to an order are generally those presented or in force when the order is placed, subject to any mandatory legal requirements.

Changes will not retrospectively remove rights that have already arisen.
